Lexington, KY - Lexmark International has taken Xerox and the Commonwealth of Kentucky to court, claiming the state has twice awarded its rival printing contracts at rates far higher than the Lexmark bids.
In its suit, filed in Franklin Circuit Court, Lexmark asserts that Xerox bids in 2011 and 2012 for a five-year managed print services contract was $7.5 million -nearly 50 percent- higher than its own.
The 2011 Xerox bid was succesfully contested by Lexmark.
Managed print services is a growing and very competitive sector of the industry, providing highly efficient printing operations to organizations.
The Lexmark lawsuit also contends that the Finance and Administration Cabinet appears to have destroyed relevant documents.
Lexmark, headquartered on Newtown Pike employs 2,300. Xerox, which acquired ACS in 2010, employs about 5,000 Kentuckians.
